This website is operated by Echo’s Treats LLC. Throughout these Terms of Service, the terms “Echo’s Treats,” “we,” “us,” and “our” refer to Echo’s Treats LLC.

Echo’s Treats offers this website, including its information, products, ordering tools, forms, memberships, and related services, to you subject to these Terms of Service and the additional policies referenced below.

By visiting www.echostreats.com, creating an account, submitting a form, placing an order, purchasing a membership, or otherwise using the website, you agree to these Terms of Service.

Please read these Terms carefully before using the website. If you do not agree to them, you should not use the website or purchase products through it.

Our online store is hosted by Shopify Inc., which provides the ecommerce platform used to display products, process orders, manage accounts, and support checkout.

1. Eligibility and Electronic Agreement

You must be at least 18 years old or the age of legal majority where you live to make a purchase or enter into an agreement through this website.

A minor may use the website only with the involvement and permission of a parent or legal guardian.

By selecting an acceptance box, submitting an order, enrolling in a membership, or otherwise completing an electronic transaction, you agree that your electronic action may serve as your acceptance of these Terms and any applicable order terms.

You are responsible for reviewing the information displayed before submitting an order.

2. Changes to These Terms

We may update these Terms when reasonably necessary to reflect changes to our website, products, services, technology, business practices, or legal obligations.

The updated Terms will be posted on this page with a revised “Last updated” date.

Changes will not retroactively alter the material terms of an order that we have already accepted unless:

  • You agree to the change

  • The change is required by law

  • The change is necessary to correct an obvious error

  • Another policy or agreement governing the order expressly allows the change

Material changes to recurring memberships will be communicated as described in our Purchase Options Cancellation Policy and as required by applicable law.

Products, availability, ingredients, designs, prices, pickup options, event dates, and services may change over time.

Some products are seasonal, made to order, available only during specific ordering windows, or offered in limited quantities.

We may discontinue a product or service at any time. Discontinuation does not remove our responsibility to fulfill, refund, or otherwise appropriately resolve an order we have already accepted.

4. Product Images, Descriptions, and Handmade Variations

We make reasonable efforts to display and describe products accurately.

Because many Echo’s Treats products are handmade, decorated by hand, or prepared from natural ingredients, reasonable variations may occur in:

  • Color

  • Shape

  • Size

  • Texture

  • Decoration

  • Placement of design elements

  • Natural ingredient appearance

  • Packaging

Screen and device settings may also affect how colors appear online.

These reasonable variations are not considered defects when the product remains materially consistent with its description and intended use.

Customized items may be inspired by customer requests, examples, themes, or reference images, but exact duplication is not guaranteed unless expressly agreed to in writing.

5. Products Intended for Dogs

Unless a product page clearly states otherwise, Echo’s Treats food and beverage products are intended for dogs.

Dog treats, canine beverages, cakes, and similar products are intended as occasional or supplemental products and are not a substitute for a complete and balanced diet.

You are responsible for:

  • Reviewing available ingredient and feeding information

  • Selecting products appropriate for your dog

  • Considering your dog’s size, age, health, chewing habits, and dietary needs

  • Supervising your dog when appropriate

  • Following storage, serving, and use instructions

  • Consulting a veterinarian regarding allergies, medical conditions, dietary restrictions, or other health concerns

Stop serving or using a product if your dog experiences an unexpected or adverse reaction, and contact a veterinarian when appropriate.

Information provided through our website, labels, social media, events, or customer communications is general product information and is not veterinary advice, diagnosis, or treatment.

6. Allergies and Ingredient Questions

Ingredient information is provided on product pages, labels, nutritional-information pages, or upon request when available.

Customers with allergy or sensitivity concerns should contact Echo’s Treats before ordering.

Although reasonable care is used during preparation, we cannot guarantee that every product is free from trace contact with ingredients used in the same preparation environment unless we expressly confirm otherwise in writing.

The customer is responsible for disclosing relevant allergy or ingredient concerns before purchasing a custom, wedding, event, or made-to-order product.

7. Orders and Order Acceptance

Submitting an order creates a request to purchase. An automated order confirmation acknowledges that we received the order but does not necessarily mean that every part of the order has been finally accepted.

We may contact you for clarification regarding:

  • Pickup dates or locations

  • Customization details

  • Product availability

  • Ingredient questions

  • Wedding or event information

  • Quantity

  • Pricing errors

  • Payment concerns

  • Suspected fraud or unauthorized activity

We may refuse, limit, or cancel an order for legitimate and lawful business reasons, including:

  • Product unavailability

  • An obvious pricing or listing error

  • Incomplete or conflicting order information

  • An unavailable pickup date

  • Inability to safely or lawfully fulfill the order

  • Suspected fraud or unauthorized payment

  • Attempted resale or commercial use of a personal-use offer

  • Repeated misuse of promotions, memberships, or customer accounts

  • Abusive, threatening, or unlawful conduct

We will not refuse service for an unlawful discriminatory reason.

If we cancel a paid order and cannot provide an agreed-upon alternative, we will issue the appropriate refund in accordance with our published policies.

8. Prices, Payments, and Taxes

Prices are shown in the currency displayed on the website and may change without notice for future purchases.

A price change will not ordinarily affect an order we have already accepted.

If a product is listed at an obviously incorrect price, we may:

  • Contact you and offer the choice to pay the correct price

  • Offer a reasonable substitute

  • Cancel the affected item and issue a refund

Payment must be successfully authorized before an order is considered paid.

Customers are responsible for providing complete and accurate billing, contact, and payment information.

Applicable sales taxes and other legally required charges may be calculated at checkout.

9. Accounts and Customer Information

You may be permitted or required to create a customer account to manage orders, memberships, or recurring purchases.

You are responsible for:

  • Notifying us if you believe your account has been accessed without authorization

You may not impersonate another person, create an account using false information, or use another customer’s account without permission.

We may suspend or restrict an account when reasonably necessary to address fraud, security concerns, policy violations, abusive conduct, or unlawful activity.

10. Custom and Personalized Orders

Custom and personalized products are prepared based on the information submitted by the customer.

You are responsible for providing accurate:

  • Names and spelling

  • Dates

  • Quantities

  • Colors or themes

  • Flavor selections

  • Design requests

  • Pickup information

  • Contact details

  • Allergy or ingredient concerns

Echo’s Treats is not responsible for an error that appears exactly as it was submitted or approved by the customer.

Requested changes are subject to availability and may result in additional charges. Changes may not be possible after ingredients, packaging, decorations, materials, or production work have been committed to the order.

Custom and personalized products are subject to our Returns and Refunds Policy and Purchase Options Cancellation Policy.

11. Customer-Provided Designs and Intellectual Property

When you submit a logo, image, phrase, design, name, or other material for use on a custom product, you represent that:

  • You own the material

  • You have permission to use it

  • Its use does not infringe another person’s trademark, copyright, privacy, publicity, or other rights

  • It is not unlawful, threatening, hateful, obscene, defamatory, or misleading

Echo’s Treats may refuse a customization request that we reasonably believe violates these Terms or another person’s rights.

You remain responsible for claims arising from material you supplied or directed us to reproduce.

12. Wedding and Large-Event Orders

Wedding cakes, wedding favors, large-event orders, and other substantial custom orders may require:

  • A written estimate or invoice

  • A 50% nonrefundable reservation deposit

  • A final-payment deadline

  • Customer approval of order details

  • A separate order agreement

  • Specific pickup, delivery, setup, or storage arrangements

A requested date is not reserved until the required deposit has been received.

Wedding and large-event cancellations are governed by the Purchase Options Cancellation Policy and any additional written order agreement.

When an invoice or signed agreement contains terms specific to an order, those specific terms control over a conflicting general statement in these Terms.

13. Pickup and Local Delivery

Echo’s Treats primarily fulfills orders through scheduled local pickup, market pickup, and approved local delivery arrangements.

Customers are responsible for reviewing and following the pickup or delivery information shown:

  • On the product page

  • At checkout

  • In the order confirmation

  • In any direct communication from Echo’s Treats

Orders must be collected at the agreed date, time, and location.

Responsibility for transporting, handling, and storing a product passes to the customer or authorized recipient after the product has been accepted at pickup or delivery.

14. Product Storage and Care

Customers are responsible for following all storage, refrigeration, freezing, serving, and use instructions provided with a product.

Do not leave perishable products in a hot vehicle or in hot or humid conditions for an extended period.

Echo’s Treats is not responsible for spoilage, melting, breakage, contamination, deterioration, or other damage caused after pickup or delivery by:

  • Improper storage

  • Excessive heat or humidity

  • Freezing or refrigeration contrary to instructions

  • Leaving products unattended

  • Improper transportation

  • Opening or altering packaging

  • Serving a product after its recommended use period

This section does not limit responsibility for a product that was defective, unsafe, or materially incorrect when provided to the customer.

15. Returns, Refunds, and Exchanges

Returns, refunds, damaged products, custom orders, missed pickups, and nonreturnable food products are governed by our Returns and Refunds Policy:

Customers should review that policy before ordering.

Nothing in these Terms removes a refund, replacement, cancellation, or other right that cannot legally be waived.

16. Cancellations and Recurring Purchase Options

Order cancellations, wedding deposits, recurring memberships, automatic renewal, benefit redemption, pauses, and membership cancellation are governed by our Purchase Options Cancellation Policy:

Recurring membership terms, including price, frequency, benefits, and cancellation options, will also be presented when the customer enrolls.

By enrolling, the customer authorizes recurring charges according to the terms displayed at enrollment until the membership is canceled.

Where required, we will provide renewal, confirmation, management, or cancellation notices in accordance with applicable law.

17. Membership Benefits

Membership benefits are subject to:

  • The membership description displayed at enrollment

  • The Purchase Options Cancellation Policy

  • Any eligibility, redemption, expiration, or usage terms shown with the benefit

Unless expressly stated otherwise:

  • Membership benefits are for the member’s personal use

  • Unused monthly benefits do not accumulate

  • Benefits have no cash value

  • Discounts cannot be added retroactively

  • Benefits may not be shared, transferred, or resold

  • Discounts may not be combined with other offers

  • Benefits are unavailable while a payment is overdue or a membership is paused

We may reasonably modify future membership benefits or pricing after providing applicable notice and an opportunity to cancel before a material change takes effect.

18. Promotions, Discount Codes, and Gift Cards

Promotions and discount codes may be subject to:

  • Expiration dates

  • Product exclusions

  • Minimum purchase requirements

  • One-use limitations

  • Customer eligibility requirements

  • Restrictions on combining offers

Unless expressly stated otherwise, promotional codes:

  • Have no cash value

  • Cannot be applied after an order is placed

  • Cannot be combined

  • Cannot be transferred or resold

  • May be canceled if obtained or used through fraud, error, or abuse

Gift cards are governed by the terms provided when issued and applicable law.

19. Events, Markets, and Experiences

Markets, tasting experiences, Pups & Pints events, community events, and similar activities may be changed, postponed, relocated, or canceled because of:

  • Weather

  • Venue decisions

  • Safety concerns

  • Illness

  • Emergencies

  • Low availability

  • Circumstances outside our reasonable control

We will make reasonable efforts to communicate material changes to affected customers.

A ticket, reservation, product order, or event purchase is subject to the cancellation and refund terms displayed for that specific event or product.

Participation in an event may also be subject to venue rules, dog-handling requirements, waivers, safety instructions, or separate event terms.

20. Dog and Participant Conduct at Events

Customers are responsible for maintaining reasonable supervision and control of dogs accompanying them to an Echo’s Treats event or activity.

Echo’s Treats or the venue may require a dog or participant to leave when reasonably necessary to protect safety, prevent disruption, comply with venue rules, or respond to threatening or dangerous conduct.

Participation may be refused or ended for legitimate safety reasons, including uncontrolled aggression, repeated interference with other guests, or failure to follow reasonable event instructions.

This section does not create a guarantee that an event environment will be appropriate for every dog.

21. Website Content and Intellectual Property

Unless otherwise stated, the website and its original content are owned by or licensed to Echo’s Treats LLC.

This includes:

  • Business names and branding

  • Written copy

  • Photographs and graphics

  • Product names

  • Product descriptions

  • Page layouts

  • Logos

  • Downloadable materials

  • Original designs

  • Event and program concepts as protected by applicable law

You may use the website for personal, noncommercial shopping and informational purposes.

By voluntarily submitting content for publication, you grant Echo’s Treats a nonexclusive, royalty-free license to use, reproduce, display, edit for length or formatting, and share that content for business, promotional, website, and social-media purposes.

This permission applies only to content you voluntarily submit for publication or promotional use. It does not give us ownership of your private customer-service communications.

You represent that submitted content:

  • Is accurate to the best of your knowledge

  • Does not infringe another person’s rights

  • Does not disclose private information without permission

  • Is not fraudulent, unlawful, threatening, defamatory, obscene, or malicious

  • Does not contain harmful code or spam

We may decline to publish or may remove content that violates these standards.

We are not required to compensate you for unsolicited suggestions or general feedback.

For claims directly related to a purchased product or service, our liability will not exceed the amount paid for the product or service giving rise to the claim, except when a greater remedy is required by applicable law.

These limitations do not apply to liability that cannot legally be excluded or limited, including liability arising from:

  • Fraud

  • Willful misconduct

  • Gross negligence

  • A violation of nonwaivable consumer rights

  • Personal injury or property damage to the extent liability cannot lawfully be limited

30. Indemnification

To the extent permitted by law, you agree to defend and indemnify Echo’s Treats LLC against third-party claims resulting directly from:

  • Your material violation of these Terms

  • Content, designs, logos, images, or other materials you submitted without the necessary rights or permission

  • Fraudulent, abusive, or unauthorized activity conducted through your account

This section does not require you to indemnify Echo’s Treats for our own negligence, misconduct, legal violation, or breach of these Terms.

31. Suspension and Termination

You may stop using the website at any time.

We may suspend or terminate access to an account or service when reasonably necessary because of:

  • Fraud

  • Security concerns

  • Nonpayment

  • Repeated failed payments

  • Unlawful conduct

  • Threatening or abusive behavior

  • Material violation of these Terms

  • Misuse of membership benefits, promotions, or chargebacks

Termination does not eliminate amounts properly owed for products or services already provided.

Terms that by their nature should survive termination, including payment obligations, intellectual-property protections, limitations of liability, and dispute provisions, will remain in effect.

32. Governing Law and Consumer Rights

These Terms and transactions with Echo’s Treats LLC are generally governed by the laws of the State of Wisconsin and applicable federal law, without regard to Wisconsin’s conflict-of-law rules.

However, this choice of law does not deprive a consumer of mandatory protections that cannot legally be waived under the law of the state where the consumer resides or where the transaction occurs, including applicable protections for Minnesota consumers.

Any dispute may be brought in a court with lawful jurisdiction over the parties and the dispute.

Nothing in these Terms prevents either party from seeking relief from a government consumer-protection agency or exercising a right that cannot legally be waived.

33. Severability

If a court determines that a provision of these Terms is unlawful or unenforceable, that provision will be enforced to the maximum extent permitted or, when necessary, severed.

The remaining provisions will continue in effect.

34. No Waiver

If Echo’s Treats does not immediately enforce a provision of these Terms, that does not permanently waive our right to enforce it later.

A waiver is effective only when clearly stated in writing by an authorized representative of Echo’s Treats.

35. Entire Agreement and Order of Control

These Terms, together with our posted policies and any applicable invoice, product terms, membership offer, or signed agreement, form the agreement between you and Echo’s Treats regarding the applicable transaction.

When documents conflict, the following order generally applies:

  1. A signed agreement or order-specific invoice

  2. The specific terms displayed for the product, membership, or event

  3. The Purchase Options Cancellation Policy

  4. The Returns and Refunds Policy

  5. The Pickup and Delivery Policy

  6. These Terms of Service

The Privacy Policy governs personal-information practices.

This order of control does not override a right or obligation imposed by applicable law.
